title
Approve the award of Change Order #2 to Contract 21-001, 2021 Resurfacing Program - MFT, to K-Five Construction for an additional 7 days
body

DEPARTMENT: Transportation, Engineering and Development

SUBMITTED BY: William J. Novack, Director

BACKGROUND:
City Council awarded Contract 21-001 to K-Five Construction on April 20, 2021 with a completion date of July 16, 2021. The purpose of this contract is to resurface various city streets as part of annual street maintenance program.

DISCUSSION:
This change order is requested to extend the completion date of the project to July 23, 2021. The contract had a starting date of early May 1, 2021 with an approved completion date of July 16, 2021. However, there are three subdivisions (Ivy Ridge, Prairie Crossing and Clow Creek) in this program located adjacent to schools and no construction was allowed until June 7, 2021 when school ended for Summer break. This gave the contractor six-weeks to complete the work and in general is appropriate based on the average weather in Naperville. However, from June 7 to July 16, 2021, an above average amount of rain occurred which significantly reduced the amount of working days. Due to the delays stated, the project can't be completed by July 16, 2021. K-Five has requested a time extension of the project, which we believe it is a reasonable request and recommend approval. This change order increases the original contract expiration date by 7 days.

I, Yifang Lu, of Transportation, Engineering and Development Group, certify that this time is necessary for successful completion of this work/project/contract. I further certify that the circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed, or the change is germane to the original contract as signed, or the change order is in the best interest of the city and authorized by l...
