BACKGROUND:
The subject property is zoned R1A (Low Density Single-Family Residence District) and is located southwest of the intersection at Chicago Avenue and Pembroke Road. The approximately 2.11-acre property is currently improved with a single-family residence and associated driveway.

DISCUSSION:
Daniel Roberts (Petitioner), with permission from Joseph Imburgia (Property Owner), has submitted a request to subdivide the existing lot into two lots. The existing home and associated driveway will be removed, and two new single-family homes will be constructed on Lot 1 and Lot 2.

Preliminary/Final Plat of Subdivision and OAA
The Petitioner seeks approval of a Preliminary/Final Plat of Subdivision and an Owner's Acknowledgement and Acceptance (OAA) agreement in order to subdivide the property into two lots. Attached to the ordinance approving the Preliminary/Final Plat of Subdivision is an OAA agreement which includes further details on the school and park donation and work required to be performed on the subject property.

The proposed lot sizes will be 36,378 square feet and 55,547 square feet in size. The Preliminary/Final Plat of Subdivision complies with the minimum lot width and size requirements for the R1A zoning district, as well as the ninety percent rule.

City Council review and approval is required per Section 7-2-5:5 (Subdivision Plat Procedures: Review) of the Municipal Code. Staff recommends approval of the subdivision request.
