BACKGROUND:
On May 4th, 2021 City Council awarded Contract 21-003 to Denler, Inc. for an amount not to exceed $359,110.12 plus a 5% contingency. The purpose of the contract was to have a contractor perform fiberized crackfilling on various City streets. Crackfilling consists of cleaning and sealing of any cracks, voids, or joints two inches in width or less with asphalt cement reinforced by polypropylene fibers. It is a cost-effective, preventative maintenance technique and, when performed routinely, can keep water and debris from getting into the pavement.

DISCUSSION:
This change order is requested to allow Denler, Inc to keep working up to July 9th, 2021 since they were unable to perform the work on multiple days due to rain and high temperatures exceeding 85-degrees. Denler was unable to work on 5/19, 5/28, 6/7, 6/8, 6/26, 6/28, 6/29, and 6/30 due to rain. Denler was unable to work on 5/24, 6/5, 6/9, 6/18, and 6/19 due to high temperatures exceeding 85-degrees.

I, Ray Fano, of TED certify that this work is necessary for successful completion of this contract. I further certify that the circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed and is in the best interest of the city and authorized by law.

This contract was approved with contingency in the amount of 5%($17,955.51) of the original contract value and 29 days. Staff requests allowing Denler, Inc. to have all contract work be one hundred (100%) complete by July 9, 2021 for the change order. A summary of the award and contingency information is provided in the tables below.
