BACKGROUND:

During New Business at the July 19 meeting, the City Council directed staff to draft a resolution to be considered at the August 16 meeting calling for further amendments to HB 3653 (Safe-T Act).

 

DISCUSSION:

The attached resolution was drafted with a conscious effort to identify public safety concerns about the current state of the bill without developing specific solutions.  We recognize this is a statewide law and all stakeholders need to be at the table to address the legitimate concerns including but not limited to:

1.                     Unreasonably limiting the imposition of cash bail

2.                     Unreasonably limiting police officer discretion to make arrests

3.                     Imposing unreasonable certification and decertification standards

4.                     Mandating unreasonable custodial accommodations
