LIQUOR COMMISSION AGENDA ITEM

ACTION REQUESTED:
title

Consider Cheap Cheap Liquors request for a Class D - Package Store license

body

DEPARTMENT:                     Mayor’s Office

SUBMITTED BY:                     Miranda Barfuss, Assistant to City Council

Cheap Cheap Liquors would like to open a liquor stores in one location:

1274 E. Chicago Ave. (previously Peterson’s Spirits & Fine Wines)

Their previous request was for 2 locations, however, the location at 88 W. Gartner Rd. #104 is no longer being requested.

They are requesting a Class D - Package Store license for the location. The current municipal code requires that Class D - Package Stores must be in a center containing not less than 60,000 square feet and there is a maximum of 1 licensee per center.

There is an existing Class D license holder in the location - Butera Market. Peterson’s Spirits & Fine Wines also previously held a Class D license in that center.  This was allowed because the business was in existence prior to the revision in the liquor code that impacted the Class D license requirements.

The Mayor approved the request if Butera could both be converted from a Class D license holder to a Class G1 - Grocery Store license holder. Butera cannot be converted because they currently have a promotional tasting permit that is not permitted with a G1 license.

The petitioner is requesting a text amendment to the liquor code that will allow the business to hold a Class D license.
