BACKGROUND:
Dan Huffman, Children’s Pastor of The Compass Church, submitted a request (attached) for approval to utilize a four-beam searchlight during the live Walk-Thru Nativity Scene which will be held on December 10 (from 5 p.m. to 9 p.m.) and December 11 (from 6 p.m. to 10 p.m.).
Per Section 6-16-3 (Prohibited Signs) of the Naperville Municipal Code, any signs or attention getting devices that rotate, revolve, or have any visible moving parts designed for the purposes of attracting attention, including but not limited to searchlights, are prohibited.
DISCUSSION:
Section 6-2-11 (Temporary Buildings, Structures, and Uses of Land) of the Naperville Municipal Code permits the City Council to authorize a temporary use for a parcel of land which does not conform to the Zoning Regulations provided that such use will not have an adverse impact on surrounding properties or the public health, safety and general welfare. Staff has no concerns with the requested temporary use.
Approvals
In 2020, the City Council approved a temporary use to permit The Compass Church to utilize spotlights (consistent with what is currently being requested). Staff did not receive any complaints about the 2020 approval. Should the City Council concur with the 2021 request, future spotlight requests for the live Walk-Through Nativity Scene will be approved by staff using the allowances provided in Section 6-2-11 for temporary uses which are found to have no adverse impact.
