BACKGROUND:

Phyllis Egizio filed a lawsuit against the City of Naperville, Saints Peter and Paul Church, and the Catholic Diocese of Joliet in 2015 for damages related to a 2014 trip and fall near the alley behind the church. 

 

DISCUSSION:

The City defended the lawsuit for seven years and a trial is scheduled for May 10, 2021.  The parties participated in mediation on May 5, 2021 to resolve the matter prior to trial.  Egizio agreed to accept a settlement of $60,000 from the City in resolution of her claims.  The resolution of this matter is being discussed in Closed Session on April 20, 2021. 

 

FISCAL IMPACT:

The City will make a one-time payment of $60,000.
