BOARD/COMMISSION REVIEW:
Not required.

BACKGROUND:

There have been several recent requests for City Council approval to permit improvements such as blade signs and balconies to overhang the City’s public right-of-way.  Prior to forwarding these requests to the City Council, City Departments review the proposed encroachments to ensure that they comply with all Code requirements, including minimum clearances and building codes.  For those requests that have been reviewed by the City Council, each has been approved with limited to no discussion.

DISCUSSION:

In an effort to reduce processing time for both the property owner and the City, staff has prepared an amendment to the Code that would permit the City Manager to administratively approve these agreements.  Please note that if the proposed amendment is passed, staff will still have the ability to forward any proposed encroachments that may be of concern to the City Council for approval through the agenda process.
