BACKGROUND:

At its October 1, 2019 meeting, the City Council amended the Naperville Municipal Code to allow vehicle vending at the train stations. The Council also directed staff to negotiate a successor agreement with Harry’s Catering to allow the vehicle vending business to continue operations at the 5th Avenue station.

 

DISCUSSION:

Staff has negotiated a successor agreement with Harry’s Catering. The terms of the new agreement are substantially similar to the prior agreement and provide a two-year initial term with three automatic one-year renewals unless either party terminates the agreement by sending written notice 90 days prior to the renewal date. The agreement is non-transferrable. Harry’s Catering has reviewed, approved and signed the agreement. Upon approval, the agreement will allow Harry’s Catering to continue to vend at the 5th Avenue train station at the same location, subject to the agreement’s conditions.

 

FISCAL IMPACT:

The City will receive $600 annually from Harry’s Catering as well as payments for electricity used.
