BACKGROUND:
The City currently has funding agreements in place with the Illinois Environmental Protection Agency (IEPA), DuPage County, Will County, Kane County and the city of Aurora for the regional Household Hazardous Waste (HHW) program operated at the Environmental Campus on Fort Hill Drive in Naperville. The facility was originally permitted in 1992 in cooperation with the IEPA as the first permanent Household Hazardous Waste Drop-off in the State of Illinois. The City and its funding partners (DuPage County, Will County, Kane County, and the City of Aurora) are responsible for operational costs of the HHW facility, the City is responsible for capital costs of the facility, and the IEPA is responsible for hiring a contractor to pick up, transport, and dispose of the HHW collected at the facility.
IEPA: On June 22, 2018 the City and the IEPA entered into a five-year Intergovernmental Agreement effective from July 1, 2018 through June 30, 2023. In July of 2018, the City received notification from the IEPA that $545,000 was allocated in the State’s 2019 fiscal year (July 1, 2018 - June 30, 2019) for the transportation and disposal of material from the Naperville facility. This was the first time that the IEPA imposed a cap on the amount of funds that it would provide for collection and disposal of HHW from the Naperville facility. Staff has been closely monitoring the disposal costs and have been working with the IEPA on funding options should the disposal costs of household hazardous waste brought into the facility exceed the funding cap imposed by the IEPA before June 30, 2019. Based on calculations being used by the IEPA, it is likely that we will come in under the $545,000 cap imposed by the IEPA. If we exceed the cap, the IEPA has informed the City that they will ask us to hold HHW until the next fiscal year to the extent that we have the capacity to do that.
Funding Partners:
DuPage County - The existing agreement with DuPage County was approved by City Council on May 7, 2019 and expires on December 31, 2019. The agreement will automatically renew for three additional years if the IEPA, City, and County each appropriate adequate funding. The agreement provides $100,000 of funding for the facility.
Will County - The existing one-year agreement with Will County expired on December 31, 2018. The agreement provides $25,000 of funding for the facility.
Kane County - The Intergovernmental Agreement with Kane County contains an automatic renewal provision and therefore does not need to be renewed at this time. Kane County annually contributes $10,000 of funding for the facility.
City of Aurora - The Intergovernmental Agreement with the City of Aurora contains an automatic renewal provision and therefore does not need to be renewed at this time. Aurora annually contributes $20,000 of funding for the facility.
DISCUSSION:
The Intergovernmental Agreement between the City of Naperville and Will County (Attachment 1) is similar to the agreement that it replaces except that it includes language giving the City additional flexibility to meet the IEPA’s disposal funding cap if necessary. The agreement with Will County will be in effect from January 1, 2019 through December 31, 2019, and subject to approval of the Will County Board, shall automatically renew for two additional years if the IEPA, City and County each appropriate adequate funding.
The Intergovernmental Agreement between the City of Naperville and DuPage County (Attachment 2) is similar to the recently approved agreement that it replaces except that DuPage County has requested that the agreement be effective from June 18, 2019 through December 31, 2019 rather than January 1, 2019. This change was requested after the City Council approved the Agreement on May 7, 2019. The Agreement will, subject to approval of the DuPage county Board, automatically renew for two additional years if the IEPA, City and County each appropriate adequate funding.
Approximately 80% of the more than 22,000 visits to the facility in 2018 originated from DuPage and Will Counties. Per the agreements, both counties will reimburse the City for a portion of the expenses related to the operation of the HHW facility. In 2019, the City will receive two payments of $50,000 for a total of $100,000 from DuPage County. The City will receive two payments of $12,500 for a total of $25,000 from Will County.
FISCAL IMPACT:
The City will receive $25,000 from Will County and $100,000 from DuPage County for the operation of the regional Household Hazardous Waste facility for calendar year 2019.
