BACKGROUND:
Per the Illinois Municipal Code, the corporate authorities of municipalities are authorized to agree upon boundaries for unincorporated territory that lies within 1.5 miles of the boundaries of such municipalities. The City of Naperville and the Village of Plainfield entered into such an agreement in 1987 to further the orderly planning objectives and establish the boundaries of each municipality. The most recent boundary agreement between Naperville and Plainfield expired on February 18, 2017 (Ordinance #87-194).

Required Notice
As required by the Illinois Municipal Code, notice of the September 4, 2018 City Council meeting at which the proposed Plainfield/Naperville Boundary Agreement was to be considered was published in the Daily Herald on August 5, 2018. The notice was also published in the Herald News on August 17, 2018 for Plainfield’s Village Board consideration of the Agreement at their September 17, 2018 meeting. The notice was also posted in the public areas of the Naperville Municipal Center on August 3, 2018 and on the City of Naperville website on August 6, 2018. At the September 4, 2018 City Council meeting, consideration of the proposed Plainfield/Naperville Boundary Agreement was continued to the November 7, 2018 City Council meeting. At their September 17, 2018 Village Board meeting, the Village of Plainfield held the boundary agreement hearing. Pending Naperville City Council’s approval of the boundary agreement at their November 7, 2018 meeting, the Plainfield Village Board intends to consider the boundary agreement at their November 19, 2018 Village Board meeting.
Boundary Agreement
As noted above, the subject agreement establishes the agreed upon planning boundary between the City of Naperville and the Village of Plainfield. While this boundary does not automatically incorporate property into either municipality, it provides property owners with a clear understanding of which community they will be eligible to annex into, should they request to do so.
The proposed boundary line agreement updates the boundary line between the City of Naperville and the Village of Plainfield to reflect recent development patterns. Per the proposed agreement, the boundary line will extend east along the south edge of South Pointe Subdivision approximately 1600 feet from Route 59, then turn south to 119th Street and then extend east along 119th Street to the DuPage River (see Exhibit A of the Boundary Agreement). The establishment of this planning boundary will have no impact on any property currently located within the City of Naperville’s corporate limits. The boundary agreement also includes provisions pertaining to road work affecting 119th Street, each party’s ability to issue utility permits, and maintenance of an existing water main connection. The proposed boundary agreement, if approved, will be valid for 20 years.
