BACKGROUND:

In December 2017, the City Council approved the award of Contract 17-191, Southeast Water Works Booster Pump Upgrades, to Briesser Construction Co. for $313,700 with a completion date of July 1, 2018. The contract includes the replacement of two potable water booster pumps and associated electrical equipment at the Southeast Water Works facility.

 

A notice to proceed was sent to the contractor on December 19, 2017 and work commenced immediately after receipt of the notice.  At the request of the contractor, the City Manager approved a 29-day contract extension on June 29, 2018, to allow the contractor to resolve the pump performance issues. 

 

DISCUSSION:

The contractor and pump manufacturer have worked diligently to resolve the efficiency issues and believe they have resolved the noted issues.  To confirm the contractor’s performance claims, staff will witness the pump retest during the week of July 16, 2018. If the contractor has not corrected the issues, the City has the option to select another pump manufacturer or have the contractor pay a penalty for not meeting the performance requirements. In the event a new pump manufacturer is selected, the manufacture and delivery of new pumps will take four to five months.

 

Regardless, it is doubtful that the contractor will meet the project’s current completion date of July 30, 2018.  An additional eight-month extension allows for the City to verify the contractor’s performance claims or for the manufacture of new pumps from a different manufacturer if the pump’s efficiency falls below the specified contract requirements.

 

The contractor has worked diligently and in good faith to supply pumps meeting the specified performance requirements. 

 

Approval of this Change Order will establish March 31,2019 as the revised completion date.

 

FISCAL IMPACT:

CIP#: WU32 - Southeast Waterworks Pumps & Controls Replacement

 

This contract is expensed to the infrastructure account listed below as part of WU32. This change order requests no additional funds from the original award. The award is a time extension with no fiscal impact.
