BOARD/COMMISSION REVIEW:
The first reading on the proposed ordinance was held before the City Council on March 6, 2018.

BACKGROUND:
The attached City Council agenda item, as prepared by Michael DiSanto, City Attorney, will be presented to the City Council for their consideration on March 21, 2018. Within this agenda item, background information is provided regarding the proposed ordinance amendment; in addition, the draft ordinance (currently presented in two versions based on City Council direction) is attached for review.

Staff has additionally attached excerpts from the pending City of Naperville Downtown Streetscape report. DAC approved the design standards included in this report at their September 2017 meeting; as approved, these standards include a minimum 6' clear pedestrian concrete sidewalk and a brick paver "amenities area" (i.e., area between the concrete sidewalk and the street) which would be improved with benches, landscaping, trash receptacles, street lights, etc. The size of the amenities area will vary depending on the available width of the right-of-way along various downtown streets; the outdoor seating areas being discussed by City Council (with or without liquor service) would be located within the amenities area provided that adequate space is available. In no instance will the pedestrian concrete sidewalk be less than 6' clear.
