BACKGROUND:
On August 18, 2015, the City annexed the property located at 5S601 Tuthill Road. This was done at the request of the property owner so they could tear down the existing home and build a new home with City of Naperville sewer and water. To provide service for their property, the owners had to extend the watermain, sanitary sewer, and storm sewer to and across their property along with installing certain roadway improvements including curb/gutter and public sidewalk.
A portion of these improvements will benefit two adjacent unincorporated properties; 56S597 and 5S578 Tuthill Road. The total cost of all the public improvements was $37,762, of which $17,316.48 directly benefits the property owner who installed and paid for it. The portion of the costs that benefits the 5S597 Tuthill Road property is $4,779.53 while the portion that benefits the 5S578 Tuthill Road property is $15,665.99.
DISCUSSION:
The City has used recapture agreements to allow property owners and developers the ability to be reimbursed for a portion of the public improvement cost that they incurred to provide service to their property. This ability to be reimbursed at a future date gives many property owners the comfort to invest in their property. These agreements also distribute the public improvement cost across all benefitting properties in a fair and equitable manner.
The benefitting property owners do not have to pay the recapture amounts if they never annex into the City of Naperville. If they do decide to annex, then the City will collect the recapture amount and convey it to the individuals who paid for the installation of the improvements, in this cas...
