DISCUSSION:

The City received a fair housing complaint in November 2017. Following the initial submittal of the fair housing complaint form, the complainant submitted a substantial amount of information. The respondent subsequently provided a lengthy response to the alleged fair housing violation.

 

The review panel reviews the entirety of the information submitted and may determine which of the following courses of action are appropriate:

a)                     no probable cause exists for filing of the complaint, and the complaint should be dismissed;

b)                     probable cause exists for filing of the complaint, and the complaint should proceed to a full hearing before the full Commission; or

c)                     mediation between both parties in order to come to a resolution acceptable to the parties - if conciliation of the complaint through mediation is not achieved, the complaint should proceed to a hearing before the full Commission.

 

If the review panel determines the complaint should proceed to a hearing before the full Commission, the hearing will be held at a subsequent HAC meeting in accordance with the Hearing Procedures set forth in Municipal Code Section 10-5-6-3 (Hearing Procedure).
