BACKGROUND:
On August 20, 2024, the City Council passed an ordinance approving a variance to Section 6-2-10:5 (Accessory Buildings, Structures and Uses of Land: Percentage of Rear Yard Occupied) of the Naperville Municipal Code in order to allow for a pavilion with fireplace to cover more than 25% of the required rear yard at 923 Watercress Dr. (Ordinance 24-082). This ordinance was approved and signed by the Mayor on August 21, 2024.
The variance provisions stipulate that no variance shall be valid for a period longer than two years from the date of the ordinance granting the variance unless a building permit is obtained within such period and the erection or alteration of a building or structure is started or the use is commenced within such period (Section 6-3-6:4 of the Naperville Municipal Code). As such, Ordinance 24-082 has an effective period of two years with the effective period ending on August 21, 2026. To date, the Property Owner, Kevin Lorenz, has submitted for a building permit but the permit has not been issued and no work on the pavilion and fireplace has commenced.
DISCUSSION:
Section 6-3-6:4 (Effective Period of a Variance) of the Naperville Municipal Code allows a property owner to request the City Council extend the effective period of an ordinance for one year without reapplication to the Planning and Zoning Commission so long as the request is made prior to the expiration of the variance.
