BACKGROUND:

In the past ten years, the City of Naperville has experienced an increase in non-legitimate use of Municipal Parking Lots, specifically the downtown parking decks.

 

The Naperville Police Department (NPD) has witnessed and received complaints from citizens and businesses ranging from nuisance level noise to criminal activity. Specifically, criminal activity has included vandalism, criminal damage to property, defacement of property (graffiti), underage drinking, drug violations, violations of the Illinois Vehicle Code (reckless driving/squealing tires) and weapons violations.

 

The NPD has committed significant resources to curtail the activity and recommend adding language to the Municipal Code allowing officers to better enforce trespassing within the Municipal Parking Lots.

 

This approach has been successfully used by other municipalities experiencing similar activity.

 

DISCUSSION:

The proposed amendment seeks to clarify legitimate uses of Municipal Parking Lots which will enable the NPD to address the ongoing activity more effectively. Essentially, this will authorize enforcement of trespassing violations in the Municipal Parking Lots by limiting the use of the lots to only the parking of vehicles and the ingress and egress to and from the vehicles by the owners or operators of those vehicles.

 

The proposed ordinance similarly addresses bicycle-related activity in the Municipal Parking Lots.

 

Violations will result in the issuance of a citation that requires a court appearance and is punishable by a fine plus court costs.
