BACKGROUND:

In 2018, an action was brought by William E. Amor, deceased, and subsequently pursued by Plaintiff Jeanne Olson, as Trustee of the William Amor Trust following Mr. Amor’s death, against the City of Naperville and two former police officers making certain allegations which are contained in Plaintiff’s operative complaint (collectively, the “Parties”).

 

DISCUSSION:

After engaging in motion practice, extensive discovery, and a trial, the Parties reached a settlement resolving this matter, subject to City Council approval. The attached resolution approves the release and settlement.

 

FISCAL IMPACT:

The City has $18,000,000 in insurance coverage applicable to this matter and the City will make a one-time payment of $7,500,000 in accordance with the agreement.

 

This settlement payment was not contemplated in the 2024 Annual Budget; therefore, it is necessary to amend the budget. Item 2 of 2 (File #24-1063) is an ordinance amending the 2024 Annual Budget in the amount of $7,500,000. This one-time payment can be accommodated within the Self Insurance Fund, which holds a cash reserve balance in excess of $10,000,000.
