BACKGROUND:
On July 13, 2017, Carilynn King Murawski, individually and as special administrator and special representative of the Estate of Phyllis Manderson Davis, filed a lawsuit in the Circuit Court of the Eighteenth Judicial Circuit, DuPage County asserting wrongful death and survival action claims.
DISCUSSION:
After engaging in motion practice and extensive discovery, the City reached a settlement with the special administrator and special representative of the estate subject to City Council approval. The attached resolution approves the settlement.
FISCAL IMPACT:
The City will make a one-time payment of $750,000 payable in accordance with an order entered by the Circuit Court of the Eighteenth Judicial Circuit, DuPage County, Illinois approving settlement.
