BACKGROUND:

The Illinois Department of Transportation (IDOT) has jurisdiction over two state highways that run through the City of Naperville; Illinois Route 59 and Ogden Avenue (US Route 34).  Over the years the City has installed and maintained numerous assets in IDOT’s right-of-way including, but not limited to, utilities (water, wastewater, and electric), street lights, and sidewalks. With the exception of emergency work, all work within the right-of-way, whether being done by the City or a property owner/developer, requires a permit from IDOT. Furthermore, all work also requires a surety bond. 

 

DISCUSSION:

In lieu of having municipalities post surety bonds every year, IDOT requires municipalities to adopt resolutions pledging good faith to obtain permits and enforce that others also obtain permits from IDOT. The resolutions also guarantee that all work will be restored to substantially the same condition as it was before construction commenced. 

 

The attached resolution addresses this requirement from IDOT.
