BACKGROUND:
On July 15, 2025, City Council passed Ordinance No. 25-066 approving the final plat of subdivision and owner's acknowledgement and acceptance agreement (OAA) for Northwoods of Naperville, a 64-unit townhome development comprised of approximately 12.18 acres located off Warrenville Road. The OAA authorized by Ordinance No. 25-066 requires the owner and developer, M/I Homes of Chicago, LLC, to take all necessary steps to form a dormant SSA in order to provide funding for the private improvements for the Northwoods of Naperville subdivision in the event the owner and developer or the Northwoods Homeowners' Association fail to perform their responsibilities relative to the private improvements.

DISCUSSION:
The proposed Special Service Area No. 37 will provide funding for the continued operation, maintenance, repair and reconstruction of the private improvements for Northwoods of Naperville. The private improvements include, but are not limited to, all roads and driveways (including associated curb and gutter), streetlighting, sidewalks/carriage walks, trees, lift station with associated force main, sanitary gravity mains and service lines upstream of the lift station, water services from curb stop into each building, secondary electric service lines to the meters, storm sewer line and structures, and the storm water management facilities. In the event that either the owner and developer or the Northwoods Homeowners' Association fail to timely and adequately perform the responsibilities necessary for the private improvements, the City will have the right, but not the obligation to initiate a levy to activate the dormant SSA.
