DEPARTMENT:                     Legal Department

SUBMITTED BY:                     Jennifer Lutzke, Senior Assistant City Attorney

BOARD/COMMISSION REVIEW:
On July 7, 2022, the Liquor Commission unanimously approved the proposed amendments.

BACKGROUND:

The Class P - Manufacturer license allows for local craft beer, cider, wine, and distilled spirit manufacturers to include a retail component onsite where the manufacturers’ may offer their craft beer and cider for retail sale, both for consumption on premises and off premises (package sales).

At this time, there are four Class P licensees:

1.                     Solemn Oath Brewery, Quincy Ave

2.                     2 Fools Cider, 1864 High Grove Lane

3.                     Go Brewing, Quincey Ave

4.                     Noon Whistle Brewing, 1748 W. Jefferson

Because of the cap, there are no Class P licenses available.

DISCUSSION:

On July 7, 2022, H.H. Shufeldt Whiskey Company (“H.H. Shufeldt”) petitioned the Liquor Commission to increase the cap on the Class P liquor license from four to five.

H.H. Shufeldt is a non-distilling producer, also known as a rectifier, which means that all spirits will be purchased in bulk from a distiller. The non-distilling producer ages, blends and finishes the spirits to their own specifications, and then bottles and markets them. Examples of other non-distilling producers are Belle Meade Bourbon, Smooth Ambler Contradiction, and Joseph Magnus Bourbon.

H.H Shufeldt intends to produce gin, whiskey, bourbon and vodka. The distillery will include a tasting room with a dark wood rectangular bar, mirrors behind the bar, and rustic wooden stools, chairs and tables. It will accommodate no more than twenty people.

H.H. Shufeldt will be located at 1665 Quincy Ave, Unit 111.

Draft minutes from the July 7, 2022 Liquor Commission meeting are attached.

FISCAL IMPACT:

Corresponding increase in licensing fees and sales taxes.
