BACKGROUND:

On July 15, 2025, City Council passed Ordinance No. 25-066 approving the final plat of subdivision and owner’s acknowledgement and acceptance agreement (OAA) for Northwoods of Naperville, a 64-unit townhome development comprised of approximately 12.18 acres located off Warrenville Road.

 

The OAA authorized by Ordinance No. 25-066 requires the owner and developer, M/I Homes of Chicago, LLC, to take all necessary steps to form a dormant SSA in order to provide funding for the private improvements for the Northwoods of Naperville subdivision in the event the owner and developer or the Northwoods Homeowners’ Association fail to perform their responsibilities relative to the private improvements.

 

The private improvements are generally described as private sidewalks, roadways and adjacent trees, driveways, and parking areas. Improvements also include the lift station with associated force main, certain sanitary gravity mains and service lines, certain water services, certain electric service lines, storm sewer line and structures, storm water management facilities including but not limited to the existing storm water management basin and wetland bottom best management practices.

 

DISCUSSION:

On November 18, 2025, the City Council passed Ordinance 25-130 which proposed the establishment of SSA No. 37 and scheduled a public hearing on the matter for January 20, 2026.  The public hearing was scheduled for not less than 60 days after adoption of Ordinance 25-130, and notice of the public hearing was properly given by publication and mailing. 

 

At its January 20, 2026 City Council meeting, the City Council should open and conduct the public hearing regarding establishment of SSA No. 37. 

 

After the public hearing has been closed, the City Council may direct staff to bring back an ordinance establishing the SSA upon expiration of the required 60-day objection period.  If a petition signed by at least 51% of the electors residing within the special service area and by at least 51% of the owners of land within the special service area is filed with the City Clerk objecting to its formation, then the special service area cannot be established.

 

In the absence of such a petition, staff will bring back an ordinance establishing dormant SSA No. 37 for consideration at the City Council meeting scheduled for April 7, 2026.
