BACKGROUND:
City Council passed Ordinance 17-113 (An Ordinance Vacating a Portion of Right-of-Way on Naperville-Wheaton Road) on July 18, 2017. Per the approved ordinance, 34’ of Naperville-Wheaton right-of-way is to be vacated to Naper-Olds Associates, L.P. (hereinafter “Naper-Olds”), owner of the property at 1210 E. Ogden Avenue, for use as part of their inventory storage. In consideration for vacation of this right-of-way, Naper-Olds agreed to undertake certain improvements to their property at 1210 E. Ogden in furtherance of the recommendations included in the Ogden Avenue Corridor Enhancement Initiative. Those improvements include installation of significant landscaping, construction of a corner entryway feature, and other building and signage upgrades. Per the approved ordinance, if said improvements have not been completed and approved by July 19, 2018, the ordinance vacating a portion of the Naperville-Wheaton right-of-way will become null and void and shall not be recorded.
DISCUSSION:
Since approval of Ordinance 17-133, Naper-Olds has completed the installation of the required landscaping improvements, as well as their building upgrades. Staff requested that Naper-Olds put a hold on the design of their corner entryway feature until such time as the City Council could review potential streetscape improvements recommended for Ogden Avenue from Washington Street to the City’s eastern boundary. These designs were approved by City Council on April 16, 2018.
Naper-Olds is currently working on the final designs and permitting requirements and intends to construct their corner signage in a timely manner, but will not be able to do so in accordance with the July 19, 2018 deadline. Accordingly, staff is requesting City Council approval of an extension to the deadline to install the improvements required by Ordinance 17-113 to January 19, 2019, with City Manager authority to authorize additional extensions if needed. All other provisions of Ordinance 17-113 will remain in full force and effect.
