BACKGROUND:

City Council approved the Annexation Agreement for the Naperville Polo Club Development on July 19, 2023 and approved Owner’s Acknowledgement and Acceptance Agreements for Phase 1 and Phase 2 of the development on August 17, 2023 and October 30, 2024 respectively.  According to agreements and the Naperville Municipal Code, the developer is required to convey Outlots E and F of the Naperville Polo Club Development to the City for conveyance to the Naperville Park District as part of the developer’s land-cash donation obligation. At this time Outlot E, which is approximately 5.819 acres and is located at 5904 Book Road, Naperville, and Outlot F, which is approximately 2.218 acres located at 5828 Hawkweed Drive, Naperville are being accepted by the City and will be immediately conveyed to the Park District. Attached is a letter from the Naperville Park District dated May 5, 2025 regarding the land-cash agreement and providing background on the intended use of Outlots E and F (see Memo Attachment).

 

DISCUSSION:

On April 24, 2025, the Naperville Park District passed Ordinance No. 1072 declaring that it is necessary or convenient for the Park District to use, occupy, or improve Outlot E and Outlot F of the Naperville Polo Club Development.  In turn, as required by City Code, state statute, and pursuant to its home rule authority, the City now needs to adopt a resolution authorizing the acceptance of the deed for Outlots E and F from the developer and then authorizing conveyance of Outlots E and F to the Naperville Park District. A 2/3 vote (6 votes) of the City Council is required.
