BACKGROUND:

The Downtown Naperville Alliance (DNA) is seeking approval of a temporary use to install sidewalk signs and teardrop/feather banners, both of which will be located in the City’s right-of-way, to assist with business visibility during the term of the downtown streetscape project.  Further details regarding DNA’s request can be found in the letter and pictures attached.  

 

DISCUSSION:

Section 6-16-3 (Sign Code: Prohibited Signs) of the Naperville Municipal Code provides that no person or entity shall display any of the following signs within the City of Naperville:

1.                     Off-premise signs displaying commercial speech

2.                     Any sign located in the public right-of-way

 

Because DNA is requesting signage for businesses which is both off-premise and within the City’s right-of-way, it is prohibited by current code requirements. 

 

Per Section 6-2-11 (Temporary Buildings, Structures and Uses of Land), the City Council has the authority to grant the temporary use of a building, structure, or use of land that does not conform to the regulations prescribed in Title 6 for the zoning district in which it is located.  Per this Section, the City Council shall only grant such temporary uses for specified periods of time and subject to such conditions as the City Council determines to be appropriate to protect against any potential adverse impact on surrounding properties and for safeguarding the public health, safety and general welfare.

 

Staff supports the requested temporary use to assist downtown businesses through the downtown streetscape project, subject to the following conditions:

1.                     DNA’s temporary signage will be permitted to be located within the limits of the downtown streetscape project through September 5, 2022. 

2.                     All signs shall be removed or replaced if showing signs of wear and tear.
