BOARD/COMMISSION REVIEW:
On May 5, 2022, the Transportation Advisory Board (TAB) approved the recommendation to establish an Overnight Parking Program (7-0).

 

BACKGROUND:

The overnight parking ordinance has been in effect since at least 1960. In 1989, Section 11-2A-8 was amended to change the times vehicles were prohibited from parking on the street overnight from 2:00 a.m. - 6:00 a.m. to 2:00 a.m. - 5:00 a.m. This was done to allow parking for those who left early for work and wanted the ability to park on the street prior to 6:00 a.m.

 

In recent years, staff has received numerous complaints regarding compliance. Upon evaluation, various subdivisions were identified as having a high number of on-street overnight parking citations. It was further revealed that many of the areas with low compliance were townhome communities with limited parking options due to shorter driveways and single-car garages.

 

Overnight Parking Pilot Programs

In response to complaints, the City developed an Overnight Parking Pilot Program in 2013. The program allowed residents to use a hang tag to park overnight on one side of designated streets and required active participation by the Homeowners Association to advertise the program and manage hang tag distribution.

 

The first phase of the pilot began in September 2014 in the Villages of Westglen. The streets included Bannister Drive, Fessler Avenue, Rennet Avenue and Grimes Avenue. A map of the overnight parking is outlined in Attachment 1. Resident participation was low; therefore, staff was unable to properly evaluate the program.

 

In an effort to gather more data, a second phase of the pilot program was initiated in The Enclave at Country Lakes in March 2016. The streets included Golf Ridge Circle, Genesee Drive/Court, Overlook Court, Oneida Lane, and Woodewind Drive. A map of the overnight parking is outlined in Attachment 2.

 

Resident participation was greater in The Enclave pilot program. Staff from the Transportation, Engineering and Development Business Group, Department of Public Works, and Police and Fire departments evaluated the program for potential negative impacts to City operations (emergency access, snowplowing, enforcement) and found none.

 

Recommendation

City staff has also received complaints about parking issues in townhome communities not included in the pilot program. Staff concluded that allowing overnight parking on one side of the street in an organized manner did not impact operations and further expansion of the program to other areas should be considered on a case-by-case basis.

 

Transportation Advisory Board meeting

At the May 5, 2022 meeting, the Transportation Advisory Board approved the recommendation to establish an Overnight Parking Program (7-0).  Two speakers spoke in favor of the Overnight Parking Program. They both stated that they live in townhome and condo communities where adequate parking was lacking and limited by small garages and driveways. Two speakers also spoke against the program citing impact to city operations, property values, and that the problem is not large enough for the City to create a program.

 

DISCUSSION:

The Overnight Parking Program will require each Homeowners Association (HOA) to submit an application to participate. Staff from the Transportation, Engineering and Development Business Group, Department of Public Works, and Police and Fire departments will evaluate each HOA request to ensure municipal operations are not negatively impacted.

 

After the department review, each HOA application will go through TAB and then City Council for final review and approval. Details on the Overnight Parking Program are outlined in Attachment 3.

FISCAL IMPACT:

The City will purchase Overnight Parking Program hang tags.
