BACKGROUND:
The City of Naperville ordinance governing the 9-1-1 system surcharge was originally adopted in 1992 with the establishment of the Naperville Emergency Telephone System Board (ETSB). Although certain sections were amended in recent years, much of the ordinance no longer reflects current practices or the requirements of the Emergency Telephone System Act, 50 Illinois Complied Statues 750. Recent amendments have been made to the Emergency Telephone System Act by the state legislature and as part of ongoing compliance with the Act, amendments to the City of Naperville ordinance are necessary.
DISCUSSION:
The following amendments are proposed to Section 1-9-G for several reasons:
1. Correct Surcharge Amount: On January 1, 2018, the statewide 9-1-1 surcharge imposed by the State of Illinois increased to one dollar and fifty cents ($1.50). The ordinance is being updated to reflect the correct surcharge rate.
2. Updated Definitions: Several definitions within the ordinance are being revised to reflect current industry terminology and standards.
3. Collection and Distribution of Surcharge: At one time, the City of Naperville collected its own 9-1-1 surcharge. Legislative changes shifted surcharge collection to a statewide system administered by the State of Illinois, with telecommunications carriers remitting surcharge revenue to the Illinois State Police/Department of Revenue. The statewide surcharge mechanism has been in place since at least January 1, 2016. Surcharge revenues are distributed by the State of Illinois to local 9-1-1 authorities and Emergency Telephone System Boards each month.
4. Emergency Telephone System Board Compliance: The ordinance is being revised to reflect statutory updates governing the Emergency Telephone System Board. These amendments include adding the required annual financial report, updating the Board’s powers and duties to reflect changes in State statute, and modernizing language to reflect current industry terminology. The update also removes the fixed list of allowable expenditures and instead references Section 35 of the Emergency Telephone System Act, 50 Illinois Complied Statues 750/35, which is periodically revised by the State.
