BACKGROUND:

In 2015, Naperville, Aurora and the Naperville Township initiated the land acquisition process to acquire the necessary right-of-way and construction easements for the reconstruction and widening of the North Aurora Road Underpass at the EJ&E Railroad (currently, the Canadian National Railway/Wisconsin Central. Ltd.). In 2016, Naperville, Aurora and the Naperville Township initiated design engineering to develop a final design for the project.

 

The City of Naperville entered into an Intergovernmental Agreement with the City of Aurora and the Naperville Township to share in the costs associated with improving the North Aurora Road Underpass. The original agreement and subsequent amendments one, two and three defined the general scope of the project and identified that the project would consist of multiple phases of work. The first amendment of the agreement provided for equitable distribution of costs associated with land acquisition necessary for the completion of the project. The second amendment of the agreement provided for equitable distribution of costs associated with design engineering of the project. The third amendment of the agreement provided for an equitable distribution of additional costs associated with land acquisition, land acquisition services, and design engineering for completion of the project.

 

DISCUSSION:

The proposed fourth amendment to the intergovernmental agreement provides for an equitable distribution of the following additional costs associated with design engineering for completion of the project.

1.)                     Additional engineering for a temporary soil retention system for construction of the railroad bridge is required for completion of the project (change order to contract approved under previous agenda item 22-0178).

2.)                     Due to the time elapsed from the original approval of the Phase 1 Engineering along with a few minor changes to the project since the original Phase 1 Engineering approval, Illinois Department of Transportation (IDOT) has required a full re-evaluation of Phase 1 Engineering along with a public information meeting (change order to contact approved under previous agenda item 22-0816).

3.)                     As part of the relocation of an Enbridge petroleum gas pipeline, an additional reimbursement agreement was entered into under previous agenda item 22-0649 and a future reimbursement agreement will be entered into in order to complete the required engineering for the pipeline relocation.

 

Staff recommends adopting a resolution approving the Fourth Amendment to the Intergovernmental Agreement between the City of Naperville, the City of Aurora, and the Naperville Township for the additional design engineering associated with the North Aurora Road Underpass improvements.

 

FISCAL IMPACT:

As part of an IGA with the City of Aurora and Naperville Township, the City of Naperville is responsible for one-third of the total cost of design engineering. The City of Aurora and Naperville Township will fund the balance. Funding is available as part of CIP #: BR005 - North Aurora Road Underpass
