BACKGROUND:
In 2024, the City required the developer, Mathieson House, LLC (M House), to extend the public sanitary sewer to the properties at 1075 and 1079 Parkside Road to provide sanitary service. M House paid the design, permitting and construction costs associated with the public sanitary sewer extension.
A portion of these improvements benefitted two adjacent properties: 26W021 Parkside Road and 7S270 Charles Avenue. The owners of the 26W021 Parkside Property are already obligated to pay their share of the recapture amount pursuant to an Annexation Agreement approved by the Naperville City Council on August 18, 2026 by Ordinance No. 26-079. The total cost of the public improvements was $30,814.95, $8,803.46 of which directly benefits the developer who installed and paid for it.
The remaining portion of the costs that benefit the property at 7S270 Charles Avenue is $7,629.66.
DISCUSSION:
The City has used recapture agreements to allow property owners and developers with the ability to be reimbursed for a portion of the public improvement cost that they incurred to provide service to their property. This ability to be reimbursed at a future date gives many property owners the comfort to invest in their property. These agreements also distribute the public improvement cost across all benefiting properties in a fair and equitable manner.
In the future, the benefiting properties would have been required to provide a public sanitary sewer along their frontages as a condition of redevelopment as allowed by Municipal Code Section 8-2B. This is consistent with other properties throughout the neighborhood. However, the installation of the public sanitary sewer extension by M House fulfills this requirement. The owners of the 26W021 Parkside Property are already obligated to pay their share of the recapture amount pursuant to an Annexation Agreement approved by the Naperville City Council. The only remaining benefiting property owner will only need to pay the recapture if they annex their property.
The remaining benefiting property owner at 7S270 Charles Avenue has been notified of this pending agreement. If the agreement is approved, it will be recorded against the remaining benefiting property so it can be tracked and known to anyone performing a title search of the property.
FISCAL IMPACT:
There is no fiscal impact to the City. The initial cost of the improvements was paid for by the developer of 1075 and 1079 Parkside Road and all costs will be returned to the developer.
