BOARD/COMMISSION REVIEW:
Official notice for the public hearing for DEV-0126-2025 was published in the Naperville Sun on Sunday, February 1, 2026. 

 

BACKGROUND:

The subject property is approximately 1.1-acres and is located on the southwest corner of Parkside Road and Charles Avenue. The property is currently zoned R-4 in unincorporated DuPage County and improved with a single-family residence, detached garage and shed. The property is contiguous with incorporated properties to the north, east and south. The surrounding incorporated properties are zoned R1A (Low Density Single-Family Residence District).

 

DISCUSSION:

The petitioners and property owners, Heriberto Martinez and Megan Martinez, request approval of the above listed entitlements to annex and subdivide the property into two single-family lots. The petitioners have not yet submitted building plans but intend to keep the existing single-family home and construct a second single-family home on the second lot upon subdivision.

 

Annexation and Rezoning

The petitioner is requesting annexation into the City of Naperville. The subject property is contiguous to the City of Naperville’s municipal boundaries and is therefore eligible for annexation. The Planning and Zoning Commission does not review annexation requests and information on the annexation is provided for information only.

 

Upon annexation, the petitioners seek to rezone the subject property to R1A (Low Density Single-Family Residence District). The subject property meets the R1A lot size and width requirements. Staff finds the proposed R1A zoning to be compatible with the existing zoning of surrounding properties and consistent with the Future Land Use Master Plan.

 

Findings of Fact

The petitioner’s responses to the Standards for Granting a Map Amendment are included in the attachments. Upon review, staff agrees with the petitioner’s findings and recommends their adoption by the Planning and Zoning Commission.

 

Preliminary/Final Plat of Subdivision

In association with the rezoning request, the petitioner is proposing to subdivide the 1.1-acre subject property into 2 single-family lots. The preliminary/final plat of subdivision complies with all technical zoning requirements. It is included for reference only and does not require Planning and Zoning Commission review.
