BOARD/COMMISSION REVIEW:
The Planning and Zoning Commission considered DEV-0049-2025 on July 16, 2025 and recommended approval of the request (approved 7-0). Staff concurs. 

 

BACKGROUND:

The subject property is located on the East side of S Route 59 between La Fox Avenue and Ogden Avenue.  It is zoned B2 PUD and is developed with a two-story restaurant building that is part of the larger Fox River Commons shopping center. The petitioner, Guzman y Gomez Mexican Kitchen, is seeking to demolish the existing building and construct a 2,668 square foot restaurant with a drive through and associated parking lot on the subject property.

 

DISCUSSION:

The petitioner requests approval of a major change to the Fox River Commons Planned Unit Development per Section 6-4-6:1 of the Naperville Municipal Code. A major change to the PUD is necessary due to the site changes proposed with the construction of the new building and drive through facilities. The petitioner is also requesting approval of a Final Planned Unit Development Plat for Fox River Commons to reflect the proposed site modifications.

 

The proposed restaurant is a permitted use in the B2 district and is consistent with the previous restaurant use on the subject property. Staff does not have concerns with the proposal and supports the requests.

 

Planning and Zoning Commission Action

The Planning and Zoning Commission conducted the public hearing to consider DEV-0049-2025 on July 16, 2025. No members of the public provided testimony on the request. Commissioner McDaniel asked the petitioner if they anticipate the proposed location to be busier than the existing Naperville Location. The petitioner confirmed that they do expect higher traffic at the proposed location. The PZC closed the public hearing and voted to recommend approval of the petitioner’s request (7-0). Staff concurs with the Planning and Zoning Commission’s recommendation.
