BACKGROUND:
The City Council awarded Contract 24-143, Van Buren Parking Facility 2024 LED Lighting Retrofit, to Rag’s Electric on September 17, 2024, with a completion date of December 15, 2024. The City Council approved Change Order #1 on February 18, 2025, to extend the contract to February 28, 2025 (an additional 75 days) due to a delay in shipment from the manufacturer. The purpose of this contract was for the installation of LED lighting fixtures at the Van Buren Parking Facility including replacement of light fixtures in the deck expansion and all emergency/area rescue call boxes.
DISCUSSION:
During the punch list and quality assurance inspection on February 28, 2025, it was observed that many of the new LED pendant lights installed were not functioning. After disassembling several fixtures, it was apparent that there was a manufacturing defect in the FIE emergency lights, specifically that a wire had been pinched during assembly. After installation, the vibrations of the parking deck caused the pinched wires to separate, causing the lighting to stop functioning. The manufacturer, Accuity Lighting, made several site visits in April 2025 and finally agreed to replace 72 defective lights. However, the replacement shipment that arrived in June 2025 also contained 72 defective lights with the same issue. It was not until August 2025 that Accuity Lighting replaced all defective lights with properly manufactured lights, which Rag’s Electric was then able to install, program, and test.
The Van Buren Parking Facility lighting replacement was completed on October 30, 2025. As a result of these delays, a change order is requested to extend the contract by an additional eight months to facilitate the issuance of the final payment. Due to the lighting issues, Accuity Lighting has provided a 5-year warranty covering both materials and labor for all lighting included in the project.
FISCAL IMPACT:
This Change Order is an extension of time and does not increase the value of the contract or have a direct fiscal impact.
