On March 13, 2025 the Transportation Advisory Board (TAB) approved a recommendation to amend Section 11-2A-8 of the Naperville Municipal Code and to update the Overnight Parking Program (approved 6-0). Staff concurs.
BACKGROUND:
The City of Naperville Municipal Code Section 11-2A-8 prohibits on-street parking between 2 a.m. and 5 a.m. The City has received concerns regarding compliance with this ordinance, particularly in multi-family developments that lack adequate off-street parking accommodations.
In 2022, the City Council approved the Overnight Parking Program guidelines and passed the ordinance that added a new traffic schedule to the Municipal Code.
The Overnight Parking Program is available to any multi-family development constructed prior to 2015 (when off-street parking regulations were updated in the Municipal Code) through an application and approval process. The current rules and regulations for the Overnight Parking Program are in Attachment 1.
DISCUSSION:
In the past year, more neighborhoods have requested entry into the Overnight Parking Program. During review period, staff found these neighborhoods did not fit the 2022 program criteria as the current rules and regulations do not consider smaller neighborhoods that do not have as much right-of-way for on-street parking. Along with that, the language regarding eligibility for the program that is specific to the 2015 update on guest parking requirements for new developments is not well defined. The regulations of the Overnight Parking Program were also not codified by the 2022 update to the All-Night Parking ordinance which may pose challenges for program enforcement.
After evaluation of the Overnight Parking Program, City staff recommends updating the Overnight Parking Program guidelines and All-Night Parking ordinance. If approved, eligibility for the program would be defined, the City would have the ability to enforce the Overnight Parking Program rules and regulations, and the City could tailor the program provisions (i.e. designate the streets and locations for exemption, determine the appropriate number of hangtags, etc.) to the unique constraints of each location based on staff evaluation to reduce interference with City operations. The updated Overnight Parking Program is Attachment 2. The updated ordinance is Attachment 3.
