BOARD/COMMISSION REVIEW:
The Planning and Zoning Commission (PZC) considered DEV-0016-2025 at the April 16, 2025 meeting and voted to recommend approval of the request (approved 6-0). Staff concurs.
BACKGROUND:
The subject property is located on the east side of Springbrook Square Drive between 83rd Street and Route 59. It is zoned B2 PUD and is currently unimproved. The petitioner is seeking to construct an approximately 12,700 square foot building to be utilized as a health spa and restaurant establishment. The subject property constitutes Lot 10 within the Springbrook Square PUD which has a designated land use of Office/ Mixed Use per the approved Preliminary/Final PUD Plat approved through Ordinance 06-132.
DISCUSSION:
The petitioner requests approval of a major change to the Springbrook Square Planned Unit Development per Section 6-4-6:1 of the Naperville Municipal Code. A major change to the PUD is necessary due to the requested use of land that is not in conformance with the land use designated by the approved final PUD plat. The petitioner has also submitted a Preliminary/Final Planned Unit Development Plat for Lot 10 of the Springbrook Square PUD to reflect the updated development of the subject property.
The proposed health spa and restaurant uses are both permitted uses in the underlying B2 (Community Shopping Center) zoning district, however as the subject property was designated as office/mixed use on the PUD plat, a major change modifying the PUD plat to modify the use restriction is required.
The City’s Land Use Master Plan identifies the future place type for the subject property as Neighborhood Center. Staff finds the proposed uses to be compatible with this designation and does not have concerns regarding the proposed uses. The proposed parking lot associated with the building provides the required number of parking spaces on site per Municipal Code and the proposed elevations and landscaping are in conformance with the approved PUD regulations. Staff is supportive of the requested major change to the PUD and the Preliminary/Final PUD plat.
Liquor Commission Action
The Liquor Commission considered a request by the petitioner for liquor licenses for the health spa and restaurant establishment at the February 6, 2025 meeting. The Liquor Commission voted to approve a Class B liquor license for the restaurant portion of the establishment and a Class M liquor license for the health spa with the following conditions: locker rooms must be separated from liquor areas with separation walls and no nudity with liquor service. Plans reflecting these changes shall be submitted to the Mayor's Office for final approval. No Council action on the liquor licenses is required.
Planning and Zoning Commission Action
The Planning and Zoning Commission conducted the public hearing for DEV-0016-2025 on April 16, 2025. John Wryzca provided comments in support of the request. After limited discussion, the PZC voted to recommend approval of the request (approved 6-0). Staff concurs.
