BACKGROUND:
The subject property is zoned R1B (Medium Density Single-Family Residence District) and consists of an approximately 7,533 square foot lot located on the west side of N Webster Street between W Ogden Avenue and 10th Avenue.
The petitioner and owner, Mathieson House, LLC, d/b/a M House, plans to construct a two-story single-family home on the Subject Property. To do so, the petitioner requests approval of a deviation to a 40-foot platted building setback along N Webster Street to construct the single-family home to the 30-foot front yard setback line that is required in the R1B district.
Staff is supportive of the requested deviation.
DISCUSSION:
Platted Setback Deviation
The petitioner proposes a platted setback deviation to allow a two-story single-family home to be constructed within the 40-foot platted setback line previously platted through the Ogden Avenue Addition to Naperville subdivision (recorded in DuPage County as Document R1925-192270). Section 7-1-3:2 of the Municipal Code allows City Council to grant a deviation from a platted building or setback line if the request is in harmony with the intent and character of the subdivision and complies with the required standards.
The Ogden Avenue Addition to Naperville subdivision (Document R1925-192270) depicted a 40-foot platted setback along Webster Street, which is inconsistent with the City’s current zoning setback regulations for the underlying zoning district of the subject property. The platted setback is more restrictive than the R1B zoning district’s required 30-foot front yard setback identified in Section 6-6B-7 (Yard Requirements) of the Municipal Code. The petitioner has confirmed that a 30-foot front yard setback is consistent with surrounding properties.
Pursuant to Section 7-1-13 (Platted Setbacks and Building Lines) of the Subdivision Regulations, Planning and Zoning Commission review is not required for the requested deviation. The requested deviation, if approved, will be subject to compliance with the approved site plan. If the petitioner were to seek any additional improvements in the future which encroached further into the platted building line or zoning setback, an additional deviation and/or variance would be required to be processed.
Staff is supportive of the requested deviation since the platted setback line is more restrictive than the zoning setback, the proposed setback is consistent with surrounding properties, and the proposed residence would comply with the underlying R1B zoning requirements.

The petitioner’s responses to the Standards for Granting a Subdivision Deviation can be found in the attachments. Upon review, staff agrees with the petitioner’s findings and recommends their adoption by City Council.
