Planning and Zoning Commission review is not required for this request. The petitioner provided the required notice (mailed written notice; sign posted on the property) in accordance with Section 6-3-5 (Procedures for Processing Petitions) of the Naperville Municipal Code.

 

BACKGROUND:

On October 7, 2025, the City Council approved Ordinance No. 25-120 approving a Conditional Use for single-family attached dwelling units to construct 26 two-story townhome units and 42 three-story townhome units, known as Everly Trace, on the subject property. Ordinance 25-120 includes approved building elevations for the townhome buildings.

 

On May 5, 2026, the City Council approved Ordinance No. 26-043, approving a Final Plat of Subdivision and Owner’s Acknowledgement and Acceptance Agreement for Everly Trace. This ordinance included updated building elevations to, in part, include a rooftop terrace on the 3-story townhome series. These elevations are attached to the proposed ordinance as Exhibit C (“Approved Building Elevations”).

 

The Approved Building Elevations accurately reflect the architectural style, visual character, and correct proportions of each townhome series, however, upon investigation by the petitioner, the petitioner determined that the building height measurements depicted on the Approved Building Elevations for both the two-story and three-story townhome series were incorrect and the result of a typographical error. 

 

The petitioner seeks a Minor Change to the Conditional Use approved with Ordinance No. 25-120 and the final building elevations approved with Ordinance No. 26-043 to construct the two-story and three-story townhomes on the subject property pursuant to the specifications depicted on the building elevations attached to the proposed ordinance as Exhibit D (“Updated Building Elevations”).

 

DISCUSSION:

The petitioner proposes to modify the Approved Building Elevations to correctly label the building height of the townhome buildings. The Updated Building Elevations for the two-story townhome series increases the height of the townhomes from 24’-7” to 28’-5” and provide a building height 3’-10” higher than shown on the Approved Building Elevations. The Updated Building Elevations for the three-story townhome series increases the height of the townhomes from 29’-11” to 36’-10” and provide a building height 6’-11” higher than shown on the Approved Building Elevations.

 

A Minor Change is required because the proposed modifications increase the height of the three-story townhomes by greater than 20%.

 

While height is being increased to address the typographical error, the proportions of the building elevations remain the same as the Approved Building Elevations. Further, the updated building heights for both the two-story and three-story townhome series are within the maximum height limitation of 43 feet for the OCI District.

 

Staff does not have concerns with the proposed modifications given the proposed height adheres to the Municipal Code requirements and the elevations remain visually the same as the Approved Building Elevations. Staff has incorporated the following condition into the proposed ordinance to account for differences in measuring building height at grade versus measuring building height at the datum point per the City’s definition of building height:

 

“The elevations reflect the building height based on a vertical measurement from grade. Each building permit plan set shall include a measure of building height based on the datum point for the applicable building. The Petitioner, Owner, and City (“Parties”) acknowledge that the building height based on the datum point will differ from the elevation and could increase the height by up to five inches (5”), but in all cases shall be less than the applicable height limit under Code.”

 

The petitioner’s responses to the Standards for Amending a Conditional Use can be found in the attachments. Upon review, staff agrees with the petitioner’s findings and recommends their adoption by City Council.
