BACKGROUND:

In 1963, a 50’ wide strip of right-of-way was conveyed to the City of Naperville for roadway purposes.  This right-of-way was requested at the time of platting of the Egizio Subdivision in order to accommodate the projected widening of Naperville/Wheaton Road.  At the time of dedication, Naper Boulevard did not exist; accordingly, Naperville/Wheaton Road was to be expanded to serve in the same capacity as Naper Boulevard does today.  Following design and construction of Naper Boulevard, the projected widening project of Naperville/Wheaton Road was no longer necessary.

 

DISCUSSION:

The 50’ wide strip of right-of-way is adjacent to the former Gerald Kia dealership located at 1210 E. Ogden Avenue.  Naper Olds Associates, L.P., owner of the Gerald site, has requested that the City vacate the western 34’ of the 50’ wide right-of-way to 1210 E. Ogden Avenue for use as part of their inventory storage (hereinafter referred to as the “Subject Property”); the remaining 16’ will be retained by the City in order to maintain a standard 66’ wide right-of-way for Naperville/Wheaton Road.

 

The City has prepared a vacation ordinance relative to the Subject Property which vests title in Naper Olds Associates, LP.  A plat of vacation is attached to and approved by the ordinance. Easements for current utilities located in the Subject Property will be reserved on the plat of vacation. In consideration for vacation of the Subject Property, Naper Olds Associates, LP, has agreed to undertake certain improvements to their property at 1210 E. Ogden in furtherance of the recommendations included in the Ogden Avenue Corridor Enhancement Initiative.  These improvements include the installation of significant landscaping, construction of a corner entryway feature, and other building and signage upgrades.

 

Naper Olds Associates, LP plans to perform environmental testing of the Subject Property before recordation of the vacation ordinance. After testing is complete, Naper Olds Associates, LP will notify the City to record the vacation ordinance. Consolidation of the Subject Property with the remainder of the property located at 1210 E. Ogden Avenue is provided for in the ordinance.

Staff supports the vacation of the Subject Property in accordance with the terms described above and as set forth in the attached ordinance.
