SUBMITTED BY:                     Jaime Olson, Labor and Employment Attorney

BOARD/COMMISSION REVIEW:

BACKGROUND:

The Naperville Police Department (PD) sergeants are managed under the overall direction of the Chief of Police.  Naperville PD employs 26 sworn peace sergeants with the rank of sergeant who serve as first-line supervisors who oversee teams of patrol officers, investigators, and support staff during shifts or assignments. This includes assigning tasks, monitoring performance, conducting briefings on new procedures/regulations, and providing on-the-job training.

These 26 employees are represented by the Police Sergeants Illinois Fraternal Order of Police Labor Council (“Union”) for purposes of collective bargaining. The Collective Bargaining Agreement (“CBA”) between the City and the Union expired on December 31, 2024.  The City and Union have reached agreement on a successor CBA consistent with City Council authority granted on November 19, 2024. That agreement has been ratified by the bargaining unit employees and is attached to the Resolution document as Exhibit A.

DISCUSSION:

The attached CBA contains the following changed economic terms:

Term: The agreement has a three-year term retroactive to January 1, 2025, and terminates on December 31, 2027.

Wage Schedule: Introduction of a step plan wage scale for all Sergeants (currently at a flat rate). The step plan is as follows:

VEBA hours increase: Sergeants with 20 through 30 years of service can contribute an additional 30 hours of sick leave per year to their VEBA.

Vacation Leave Cash Out/Sell Back: The parties reduced the hours of vacation leave that a sergeant could cash out/sell back to the City each year from 80 hours to 60 hours.

Acting Watch Commander Stipend: The parties eliminated the Acting Watch Commander Stipend for Sergeants. The average stipend for the last 3 years is 79 hours.

FISCAL IMPACT:

The total cost of these new pay scales over the three-year term of the CBA is $921,099.28, which equates to $452,187.84 for the first year, $320,576.69 for the second year, and $148,334.76 for the last year of the CBA.

An additional 30 hours of sick leave towards VEBA would yield a total of 1,460 hours.  The total cost of these hours is $216,335.70 for all 3 years.

Reducing the amount of vacation leave a sergeant can sell back from 80 to 60 hours has the potential to save the City of Naperville approximately $35,209.20 per year, with the savings increasing each year. The estimated total savings under the collective bargaining agreement would be around $105,627.60.

The Acting Watch Commander Stipend costs Naperville an estimated $8,585.40 per year.  Thus, the total savings with the elimination of the Stipend over the three years of the CBA is $25,756.20.

The overall estimated fiscal impact, including all of the changed economic terms, is $1,006,051.18.
